Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Nextdio, Inc. ("onlyvibe," "we," "our," or "us"). They govern your access to and use of the onlyvibe platform at onlyvibe.ai and any related services (the "Service"). By using the Service you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

onlyvibe is an adult platform. You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to create an account or use any part of the Service. By accessing onlyvibe you represent and warrant that:

• You are at least 18 years old.
• You have the legal capacity to enter into these Terms.
• Your use of the Service complies with all applicable laws in your jurisdiction.

We may terminate accounts and delete all associated data if we discover a user has misrepresented their age.

onlyvibe is an AI companion platform. You can chat with AI characters, create your own, generate images and videos, use voice messages, publish to a social feed, tip creators, and more. Key aspects:

• AI Characters — every character is entirely fictional and AI-generated. None represent, depict, or impersonate any real person.
• AI Conversations — all interactions are with AI systems, not humans. Responses are generated by artificial intelligence and may be unpredictable, inaccurate, or inconsistent.
• Generated Media — images, videos, and voice messages produced on the platform are created by AI models. They do not depict real individuals.
• Persistent Memory — AI characters maintain conversation context and memories to provide a continuous experience.
• Social Features — you can follow characters and creators, post to feeds, comment, unlock premium content, and send direct messages.
• Creator Economy — creators earn a share of tokens spent on their characters and can receive tips from other users.

You can sign up with Apple, Google, or an anonymous account. You are responsible for keeping your credentials confidential and for all activity under your account. You agree to:

• Provide accurate and complete registration information.
• Update your information promptly if it changes.
• Notify us immediately of any unauthorized access.
• Not share your account or credentials with anyone.

You agree not to use onlyvibe to:

• Create content intended to depict, resemble, or impersonate any real person — including public figures and creators on other platforms — without their explicit written consent.
• Generate, request, store, or distribute any content involving minors in any context whatsoever.
• Engage in any activity that violates applicable law.
• Circumvent age verification, access controls, or content moderation systems.
• Harass, threaten, stalk, or intimidate other users or third parties.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service or its AI models.
• Scrape, crawl, or use automated means to access the Service except via our robots.txt.
• Interfere with or disrupt the performance of the Service.
• Use the Service to develop competing AI products or services.
• Resell, sublicense, or commercially redistribute access without our written permission.

Violations may result in immediate account suspension or termination at our sole discretion.

AI-generated content — text, images, video, and audio — may be inaccurate, inappropriate, offensive, or unpredictable. We do not guarantee the quality, accuracy, or suitability of any AI output. You acknowledge that:

• AI responses are not professional advice of any kind — medical, legal, financial, or otherwise.
• AI characters are not sentient. They simulate conversation but have no feelings, consciousness, or understanding.
• You are solely responsible for how you use and interpret AI-generated content.
• We moderate content but cannot guarantee all outputs comply with our guidelines.

We use automated scoring and manual review to enforce our content guidelines. All generated content receives moderation scores that determine its classification and visibility. We reserve the right to remove content and suspend or terminate any account that violates these Terms. Moderation decisions are final.

We may send push notifications to your device for messages, updates, and activity alerts. You can manage notification preferences in your device settings or within the app at any time.

The Service is provided "as is" and "as available." We do not guarantee any specific uptime or service level. We may modify, suspend, or discontinue any feature — or the entire Service — at any time, with or without notice.

We may suspend or terminate your account if you:

• Violate these Terms or our content guidelines.
• Engage in fraudulent, abusive, or illegal activity.
• Create content that poses a risk to the safety of others.
• Misrepresent your age or identity.

You may delete your account at any time from Settings. Upon termination or deletion, your data is handled per our Privacy Policy.

You agree to indemnify and hold harmless Nextdio, Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) content you create or share on the platform.

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Disputes shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.

You agree to resolve disputes individually. You waive any right to participate in a class action or class-wide arbitration. Arbitration takes place in Wilmington, Delaware, or remotely as agreed.

Either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.

If any provision of these Terms is found unenforceable, that provision is limited or eliminated to the minimum extent necessary. The remaining Terms stay in full force.

These Terms, together with our Privacy Policy, are the entire agreement between you and Nextdio, Inc. regarding the Service. They supersede all prior agreements.

We may modify these Terms at any time. Material changes will be communicated through the platform or email at least 14 days before they take effect. Continued use after the effective date means you accept the updated Terms. If you disagree, stop using the Service.
